Summary: Kayaalp Property-former Gas Station
December 20, 2006- The NJDEP completed and reviewed a request for and Innocent Party Grant (IPG) through the NJDEP’s Hazardous Discharge Site Remediation Fund (HDSRF) program for the referenced property which was purchased in 1974. The property was purchased as vacant land in a reportedly residential area. In January of 2006, a limited Phase II Site Investigation identified the presence of underground storage tanks UST’s) from a former gas station some forty (40) years earlier. The subsequent ground water investigation in the area of the UST’s identified the presence of Bis(2ethylhexyl)phthalate (DEHP a common plasticizer in the manufacture of plastics. This compound is not typically associated with petroleum products) at 5.3 ppb, which is above the NJDEP current ground water quality standard (GWQS) for DEHP (3.0 ppb). Based on the NJDEP’s review the property was eligible for the IPG.

AOC1- Underground Storage Tanks (UST’s) - Three (3) UST’s (a 3,000-gallon Unleaded Gasoline Underground Storage Tank and two (2) 1,000-gallon Unleaded Gasoline Underground Storage Tanks) were removed November 28, 2006. Upon removal of the tanks from the ground, a visual inspection was performed and the tanks were found to be intact. No areas of petroleum staining were noted on the outside of the UST system or on the soils in the tank excavation. From the excavation of the gasoline tanks and associated piping run soil samples were collected. The samples acquired from the excavation and the piping run of the unleaded gasoline UST’s have been analyzed for VO + 10 and lead. All the results from the Lead analysis and Volatile Organic analysis were found to be non-detect or below NJDEP’s NRDCSCC. The TIC levels associated with the samples were also found to be non-detect. The laboratory results confirm Enserv’s site observation during tanks removal that no contamination was present in the excavation.
The tanks were previously unregistered. The tanks closed in this project were recently registered with the NJDEP Bureau of Underground Storage Tanks (BUST) (UST registrations No. : 295910). The tanks were initially registered as a four (4) 1,000 gallon UST’s. This was based on a geophysical investigation using ground penetrating radar (GPR) and Fisher TW-6 bulk metal detector. During removal it was discovered that there were actually one (1) 3,000 gallon and two (2) 1,000 gallon tanks. A tank registrations form was amended and sent to the NJDEP.

August 15, 2007- NOD (Notice of Deficiency) was issued to Irfan Kayaalp,
responsible property owner of Kayaalp Property. The NJDEP acknowledges receipt
on April 10, 2007 of the SIR (Site Investigation Report) submitted for UST
Rule (Underground Storage Tank) regulations and issued the following
deficiencies: Brief summary.
Deficiencies:
1. Failure to include all analytical data required in the SIR.
2. Failure to pay fee $500.00 for review of SIR.
Corrective action requested by the NJDEP: Brief summary.
1. Submit information required by the NJDEP with 30 days after receipt of
notice.
2. Submit required fees within 30 days after receipt of notice.
