In a letter from the NJDEP to Malaga Car Wash & Service Station dated

May 21, 2001:

 

November 7, 2000- NJDEP received notification of a discharge of hazardous substances from the underground storage tank.

 

March 5, 2001- NJDEP received a Remedial Investigation Report (RIR) from Malaga Car Wash & Service (hereinafter Malaga Car Wash).

 

Based on NJDEP review of the RIR submitted, deficiencies and requirements were addressed.

 

Since a sheen exists on the ground water in the excavation containing the former diesel tanks and there are potable wells in the vicinity of the site, Malaga Car Wash, was required to complete a ground water evaluation within a 1 mile radius of the site. Soil at the location of the two excavations containing the diesel tanks had elevated levels of benzene, xylene, Total Petroleum Hydrocarbons (TPHC) and MTBE. Malaga Car Wash was required to remediate the contaminated soil. (See document link attached).

 

Malaga Car Wash shall submit a Remedial Action Selection Report to the NJDEP.

 

Notification: Pursuant to NJAC 7:26E-1.4, Malaga Car Wash, shall notify the municipal clerk of each municipality in which the site is located 45 days prior to the submission of the remedial action selection report to the Department. The notification shall be in writing and shall include all information specified in NJAC 7:26E-1.4(d) 1 through10.

 In a letter from the NJDEP to Malaga Car Wash & Service Station dated November 7, 2005:

 

The NJDEP advised Malaga Car Wash that the DEP letter dated May 21, 2001 requiring the submission of Remedial Investigation Report was due September 18, 2001.

 

The NJDEP advised Malaga Car Wash that the department has not received the required documents.

Interoffice call sheet November 14, 2005

Case Manager Paul Mander called Malaga Car Wash owner regarding the Late Letter the DEP sent on 11/7/05.

“Owner said the gas station has been closed, not operating, they are selling the property and they have done all the work.” Paul Mander informed the property owners that the Departments May 21, 2001 letter has not been responded to. Paul Manner noted on his call sheet that “the owners would send some document of work done by Aqua-Tex.”

 

April 4, 2007 KCS subcommittee member contacted case manager Paul Mander who confirmed that tanks were removed in 2000 and when new tanks were put in, it was at that time that the contamination was discovered. The remedial investigation has not been completed and still requires monitoring wells to be put in to determine if ground water contamination exists. The current remedial level is a C1 which indicates no formal design. Soil samples were a concern for xylene and MTBE and would suggest possible groundwater contamination issues. This station is closed and the owners had told the DEP in 2005 that they were selling. Comments regarding the May 21, 2001 and November 7, 2005 letters from the DEP that were noted above were also discussed. No further response to date on this site.
